English writing Essay Example | Topics and Well Written Essays - 1000 words - 1

English writing - Essay Example Among the biggest differences between China and America are their cultural values and these have been cultivated over a long period. China is an extremely conservative nation with most of the cultural practices of its people being influenced to a certain degree by the teachings of the philosopher Confucius. This influence has been paramount in China for over two millennia and has guided the Chinese nation throughout all its incarnations. The culture of the United States, on the other hand, is very liberal with individuals living their lives as they see fit, making Americans very independent people from a young age. Moreover, Chinese culture dictates that younger people be subservient and submissive towards their elders, obeying them without question. Young Chinese people tend to be obliged to take care of their elders until the latter die and in most cases, elderly Chinese are very revered in the society. This is not necessarily the case in America where younger people tend to live t heir own lives without any consideration to the wishes of their elders (Weston). The elderly people in America tend to be highly independent and often live by themselves; going into homes for the elderly when they can no longer take care of themselves rather than living with their children. Another difference that arises between America and China is on their systems of education, which are in many ways managed diversely. The Chinese system of education tends to be slightly more difficult than that of America because students have to undergo a rigorous system of examinations almost at every level of their education to ensure that they are competent enough to proceed to the next level. The American system, on the other hand, is less rigorous with the number of people whose performance in school is below average being extremely high. In China, parents tend to be very involved in

Evidence Rule Essay Example for Free

Evidence Rule Essay The best evidence rule pertains to the rule that the evidence that is permissible on the court is that evidence which is original. It is because when copies of evidence are made, there is a possibility that the copy will be altered or tampered so copies are not the best evidence. The best evidence to be presented would be the original evidence. The best evidence rule implies that copies or unoriginal evidences be not permissible to the court. I think it is because the only thing that could prove the document and the involvement of that document would be the evidence itself. And the content cannot be compromised because it may lead to false conclusion of the proceedings. It is also called the â€Å"original writing rule† (Bergman Berman-Barrett, 2008) This will be discussed further later. However, a secondary source may be used as the evidence to be presented on a court trial if the original is not available. The original is pertained as the primary source. A primary source is that which is original and has come or created during an event. A secondary source would be those sources that resulted from the primary source. The content of a secondary source contains information or opinions regarding to the primary source (Eamon, 2004). It means that the secondary source comes only after the primary source and is just related to the source. So, a copy is not necessarily a secondary source. It may be a copy of a primary source. In a court trial, the primary source is what is usually preferred to be introduced. When it is not available, secondary source can be used, as said earlier. The best evidence rule states that as long as the original document is available, that should be produced for a court trial. A secondary source will only be admissible if the original document is not available. So when the original document is difficult to produce, it doesn’t mean that the secondary source can be used as an alternative. The lawyer should do his best to produce that original document. This is what it meant for the original writing rule. As I’ve mentioned earlier, the content of a document would be the document itself. There can be biases if secondary sources will be used in place of the original document. An example of introducing a secondary source in place of the primary source will be when a document that would prove that there really has been a contract been lost, say, in a fire. A secondary source, in a form of a testimony can be used as evidence. References: Bergman, Paul and Sara Berman-Barrett. 2007. Represent Yourself in Court: How to Prepare and Try a Winning Case. Competition is Great, but not Perfect :: essays papers

Competition is Great, but not Perfect In the United States today, the economy is one of the most important things to stabilize and maintain. The economy is this capitalistic nation in a way. As the economy has gone over the many years, so has the country. A good example of that is the Great Depression; everyone in the United States was doing great with the Bull Run of the market and the abundance of jobs. Then things started to change for the worst; the economy fell out with the great crash of the bare stock market and along did the people. Everything crumbled like stale bread, including people lives and families. Not until businesses rebuilt themselves and competition returned that the economy finally turned around. The country and the people, upon whose backs’ it rests finally, turned around also, pulling out of the Great Depression and returning this nation to its greatness. In the article â€Å"Competition is Great Game Plan, but not Perfect,† the author M. Ray Perryman states that the economy is doing well due to the competition between companies and firms as the title might indicate (Perryman 1). Although he states that the competition which fuels our economy has problems, like creating monopolies and companies that dominate markets, identifying them early and becoming aware of them we will be able to keep our economy on the path that it is on (1). Mr. Perryman supports this claim by using such strategies as common sense in his reasonability, relevance, and confidence by using his own voice in this successful essay. In speaking to the American public through his article, Mr. Perryman uses the rhetorical strategy of common sense and reasonability when he states such things as, â€Å"It (competition) lowers prices, enhances consumer choice, promotes innovation and forces us to use our scarce resources very efficiently† (1). This strategy works for him in because it makes a lot of sense that competition would do these things for us. Companies competing for business must always try to undercut the opponent’s prices and costs, with this more choices will be created. Another example of Perryman’s use of the common sense rhetorical strategy is when he states, â€Å"The information and technology revolution of today, which I believe to be in its infancy, is creating a wider gap between the ‘haves’ and ‘have nots’ and is likely to eliminate or greatly reduce the need for many relatively unskilled occupation (and more than a few skilled ones) over the nex t few years† (2).

Surah Al Fatiha

It is named Al-Fatihah, the Opening – because it opens the Book and by it the recitation in prayer commences. It is also named Umm al-Qur'an, the Mother of the Qur'an, and Umm al-Kitab, the Mother of the Book. It was revealed in Makkah. It consists of seven verses.EXPLANATIONAllah deserves to be praised for the perfection of His qualities and spiritual blessings. Therefore, people should praise Him for everything He has given them. He alone deserves it. He is the Lord of the worlds. He made everything that exists, maintaining it at every moment.Allah alone is the Master of the Day of Judgment, the Day when human beings will be rewarded for their deeds. Reciting this verse in every rak’ah of prayer constantly reminds a Muslim of the coming Judgment, and encourages him to do good and stay away from sins. The verse connects the heart with Allah and purifies it of pride. The ‘Straight Path’ is Islam, the clear road leading to divine pleasure and Heaven shown by Muhammad. This is a prayer from a Muslim to purify his heart of stubbornness, ignorance, and misguidance. The verse also shows Islam is Allah's greatest blessing. Those who know the way and walk on it are guided and, after the prophets they were, without doubt, the companions of Prophet Muhammad. Theme This Surah is in fact a prayer which Allah has taught to all those who want to make a study of His book.It has been placed at the very beginning of the book to teach this lesson to the reader: if you sincerely want to benefit from the Quran, you should offer this prayer to the Lord of the Universe. From this theme, it becomes clear that the real relation between Al-Fatihah and the Quran is not that of an introduction to a book but that of a prayer and its answer.Al-Fatihah is the prayer from the servant and the Quran is the answer from the Master to his prayer. The servant prays to Allah to show him guidance and the Master places the whole of the Quran before him in answer to his praye r.TEACHINGSAl-Fatihah indirectly teaches that the best thing for a man is to pray for guidance to the straight path, to study the Quran with the mental attitude of a seeker- after-truth and to recognize the fact that the Lord of the Universe is the source of all knowledge. He should, therefore, begin the study of the Quran with a prayer to him for guidance.

Audit Syariah

Tiffy Tiffeny Edmund 62288211087 Audit 1 Audit Syariah Definition Audit is a process to investigate and verify an account, while Syariah is the rule of Islam (Hukum Islam). Therefore, Audit Syariah is the process to analyse, check, investigate and to make sure the operation and the management of Islamic Financial Institution (IFI) is accordance to the principal and the Syariah’s guidelines, mainly for the production of a product.Syarikah al-Rajhi al-Masrafiyyah LiL Istismar has define the Audit Syariah as â€Å"parties to determine the extent of Syariah compliant IFI based on decision made by the Syariah Advisory Council (SAC)† Objectives * Is there any specific mechanism to ensure the implement decision of SAC based on the Muamalat Islam? * How the implement of contracts, requirements, and operation being monitored by the IFI? The importance of Syariah compliance is to mitigate the operational risk of IFI and to strengthen the internal control of Islamic Banking system .Operation risks arise out because of failure in internal controls relating to processed, people, systems, or external event. The syariah non-compliance significant with this risk, which may result in voiding of contracts, loss of income, withdrawals, diminishes reputation and reduction in business. So, key challenge in managing operational risk in Islamic banking is by ensuring syariah compliance. Therefore, it is important to have syariah auditor to control activities according the Islamic rules which permissible and compliance with the principles of syariah About audit syariahThe different between statutorily IFI of different countries against actual scope and scale of what constitutes syariah audit might be bias towards the actual nature and scope of syariah audit. Auditor that practices the syariah system should be understood as a model that those countries adopt probably due to certain constraint within their financial system or infrastructure. Primary scope of syariah audit i s the audit of financial statement of the IFI.The audit will design to review the financial statement are drawn up according to the prevailing financial reporting disclosure standard of the country and wether the financial entries truly and accurately reflects the right and obligation arising from the various syariah contracts that the IFI enters into. If the requirement of IFIs in that country is to adopt the Accounting and Auditing Organization of Islamic Financial Institution (AAOIFI) standards then adherence to AAOIFI standards would be construed as the syariah compliant yardstick. The next area of a scope is the operational aspects of the IFI. This largely depends on the type of business the IFI is involved in and the key business activities undertaken by the IFI. This will involve an examination of the policies and procedures of the IFI on the key business activities, product manuals, operational process, contracts and agreements of products, memorandum and articles of associat ion of the organization and observation of reports issued by the management or syariah supervisor board and internal review unit.Third scope is the organizational structure and the people involved in executing key activities of each business area of the IFI. Audit on this scope will ensure that the organization structure is feasible to undertake the syariah compliant business activities and those they are qualified personnel in the area of ? fiqh al-muamalat to support the operations of the IFI. Islamic commercial jurisprudence or the rules of transacting in Islamic lawFinally, the scope should also cover the IT application systems that are in place to support the key business activities of the IFI. An audit into this area would look into whether the functionalities and features of the application system are sufficient and adequate to support an Islamic Banking Business by the IFI. Few things should be emphasized by auditor is avoiding every sinful activities such as the elements of riba, channeling received funds in a sinful way, and transactions that pay interest to depositor or investment in interest bearing stocks. The Syariah Advisory Council of Malaysia security commission (SAC) had resolved that riba is one of the main criteria causing the security of listed company to be excluded from SAC approved list. Islamic Instrument Study Group (IISG) at its fifth meeting on 23th August 1995 resolves that securities of a company whose operations and main activities are based on riba are not halal. Second thing is risk sharing. Islamic finance requires each party to a transaction to share the risks and rewards in an equitable manner.Islamic finance also doesn’t allow and forbid exploitation regarding right, liability and organization of the transaction leaving no room for ambiguities. Islamic law in finance is quite flexible where it allows the undertaking of any form of contractual relationship as long they avoid the clearly stated the prohibitions in the q uran and sunah. To ensure the audit progress runs smoothly, auditor must understand every decision maked by SAC. Auditor can ask the secretariat for help or by referring the manual of syariah, syariah checklist, syariah audit report from previous year, and so on.

The Gift of Love †Creative Writing Essay

The Gift of Love – Creative Writing Essay Free Online Research Papers The Gift of Love Creative Writing Essay The feeling has been known since the beginning of time, and the warning signs have most likely never evolved. They include the heart rising to the throat, inability to catch one’s breath, blood rushing to the cheeks, and the sudden loss of any linguistic capabilities. Yet these are fleeting symptoms, so they cannot really indicate if one is experiencing a visit from that mysterious and elusive character named romantic love. As powerful as the physical onslaught of lust appears, true love is a phenomena that requires the use of one’s time, thought and energy. To love is to unselfishly be faithful to one’s own feelings for another individual. Loving is not seeking personal gain, but hoping to better the life of the other person by becoming a part of it. Love is severely complex because it requires those who seek it to give up a part of themselves to another, without regard to the personal risks that they are taking through this action. It is this type of dangerous but true love that is exhibited in Camus’ Black Orpheus (1958), which is based on the famous myth of two lovers. In this film, a true and profound love is demonstrated by Orpheus and Eurydice because of these characters’ unselfish motives and commitment to their emotions. From the beginning of the movie, Orpheus’ history of love proves him to be a philanderer who has never been serious about a woman, and who does not know how to love truly. He has recently become engaged to Mira, the biggest flirt in town, and this is not a poor match. Orpheus himself is a flatterer and a flirt who constructs enchanting phrases when he composes his famous music. His tendency to charm comes across in the scene where he first encounters Eurydice at the trolley station. He playfully inquires where she is off to and flatters her appearance. Because Orpheus has had such experience with women and relationships, one would not expect him to be able to settle down and have a woman suppress his philandering manner. Evidently, Orpheus’ fiancà © has not tamed him, as he tries to flirt with Eurydice when he meets her. The way Orpheus reacts to love can be interpreted as selfish. His meddles with women for the sake of his own amusement, not because he has a de ep appreciation of them. His generosity towards Mira does not surpass a display of mild passions for her. There is no evidence of his ability to give more to a woman than his poetic but empty words. When Eurydice rejects the charming words of Orpheus, she demonstrates her ability to see through his external act and appreciate his true identity. Orpheus and Eurydice meet again, and this time they are alone. Orpheus tries once more to charm her, and she claims that it is not his words that she noticed about him, but his tune. She knows that his words are delightful but deceptive, and she is able to see the man who is behind the words. Eurydice perceives Orpheus not as a charmer with a captivating and quick tongue, but as a man whose beautiful music extends from a brilliant soul. Eurydice proves to be both an open minded and unselfish lover when she refuses to let Orpheus use his charms on her. In the quote previously mentioned, Eurydice reveals both her ability to see Orpheus for who he really is, and also her unwillingness to receive anything less than the real man. Accepting Orpheus’ flattery would be to relinquish hopes of truly understanding who he was, because it would mean that she didn’t believe that there was anything under the words. It would also show selfishness. Accepting his empty compliments would demonstrate a desire for him to affirm her pleasant qualities. Eurydice rejects flattery because she knows her love to be deeper. She is true to the emotions which do not allow her to be a self seeker, but force her to be willing to risk giving in to her strong feelings. The generosity that Orpheus displays once he realizes the intensity of his feelings demonstrates the truth of his and Eurydice’s love. It is her straight forward attitude and ability to see through him that makes him recognize her uniqueness. He quickly becomes aware of his love for her after he sees that she is serious about him, and now he can think of nothing but her protection. He brings her to his house at night because he wants to be assured of her safety, and he does not make even the slightest sexual advances. This is where his willingness to give of himself for her is demonstrated. His constant concern shifts from his own desires to those of Eurydice. No longer does he try to extract what he wants from the relationship, because his thoughts are more pure. Orpheus and Eurydice are true lovers because there is no force that can interrupt their commitment. A physical illustration of how deeply Orpheus has loved Eurydice is shown at the end of the film, when Orpheus transports Eurydice’s dead body from the morgue back up the hillside. Eurydice is dead and can no longer give her love to Orpheus, yet even death cannot stop him from caring for her. He watches over the lifeless body and guards it vigilantly, and soon he dies with it in his arms. It is clear that this love is unconditional, because death cannot restrain it. The truest love cannot have boundaries, because that would mean that the lovers have abandoned their emotions. Orpheus is emotionally committed to Eurydice until his death. Both Orpheus and Eurydice show a willingness to change their lives so that they can fully support one another. There love was based on profound mutual care and sincere generosity, the same characteristics that define true love. Love is valid when it is not based on self interest, but the well being and happiness of the individuals involved. The commitment to giving is the beautiful ideal that is achieved by Orpheus and Eurydice in Black Orpheus.
